Participant Agreement

TERMS & CONDITIONS

Effective Date: 1st September 2025

These Terms & Conditions (“Agreement”) govern participation in any Real Madrid Foundation Soccer Camps USA program operated by Kaptiva Sports Inc., a corporation organized under the laws of the State of Florida (“Kaptiva Sports,” “Company,” “we,” “us,” or “our”).

By registering for any camp, clinic, event, training session, tournament, trip, or related activity (collectively, the “Program”), the participant and/or the participant’s parent or legal guardian agree to be bound by this Agreement.

1. REGISTRATION AND PAYMENT

A completed registration form and payment of all applicable fees, whether full or partial as specified during the registration process, are required to reserve a participant’s place in a Program.

All fees are listed and payable in U.S. Dollars (USD).

Kaptiva Sports reserves the right to refuse, suspend, or cancel any registration or participation at its sole discretion, including for safety, operational, disciplinary, or administrative reasons.

2. CANCELLATION AND REFUND POLICY

All cancellation requests must be submitted in writing via email to: info@rmfsoccercampsusa.com.

Refunds shall be issued as follows:

  • More than sixty (60) days prior to the Program start date: refund of amounts paid minus a USD $95 administrative fee.
  • Between sixty (60) and thirty (30) days prior to the Program start date: fifty percent (50%) refund of amounts paid.
  • Less than thirty (30) days prior to the Program start date: no refund.

No refunds shall be granted for:

  • no-shows;
  • voluntary withdrawal;
  • dismissal from the Program;
  • late arrivals;
  • illness;
  • injury;
  • homesickness;
  • scheduling conflicts;
  • unused portions of the Program.

Any approved refund shall be processed within a commercially reasonable timeframe.

3. PROGRAM MODIFICATIONS AND FORCE MAJEURE

Kaptiva Sports reserves the right to cancel, postpone, relocate, modify, or adjust any Program, including but not limited to:

  • schedules;
  • coaches;
  • staff;
  • facilities;
  • accommodations;
  • activities;
  • training sessions;
  • Program locations;
  • transportation arrangements.

Programs may be operated throughout the United States using third-party facilities, vendors, operators, and service providers.

Program locations may be changed within a reasonable geographic area when necessary due to operational, safety, weather-related, governmental, facility-related, health-related, or other circumstances beyond Kaptiva Sports’ reasonable control.

If a Program is cancelled prior to commencement, Kaptiva Sports’ sole obligation shall be limited to refunding amounts actually paid to Kaptiva Sports for the affected Program.

Under no circumstances shall Kaptiva Sports be responsible for:

  • airfare;
  • hotel expenses;
  • transportation costs;
  • travel expenses;
  • loss of profits;
  • loss of opportunity;
  • consequential damages;
  • incidental damages;
  • indirect damages.

Force majeure events include, without limitation:

  • severe weather;
  • natural disasters;
  • pandemics or epidemics;
  • governmental actions or restrictions;
  • public health emergencies;
  • facility closures;
  • labor disputes;
  • transportation interruptions;
  • acts of terrorism;
  • civil unrest;
  • power outages;
  • coach or staff illness/unavailability;
  • any event beyond Kaptiva Sports’ reasonable control.

4. ASSUMPTION OF RISK AND LIABILITY WAIVER

Participation in soccer and athletic activities involves inherent risks, including but not limited to:

  • physical injury;
  • concussion;
  • dehydration;
  • heat-related illness;
  • illness or infection;
  • permanent disability;
  • paralysis;
  • death;
  • collisions with participants, equipment, or facilities;
  • transportation-related risks.

The participant and parent/legal guardian voluntarily and knowingly assume all risks associated with participation in the Program.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PARTICIPANT AND PARENT/LEGAL GUARDIAN HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS KAPTIVA SPORTS INC., REAL MADRID FOUNDATION, THEIR RESPECTIVE AFFILIATES, PARTNERS, SPONSORS, DIRECTORS, OFFICERS, EMPLOYEES, COACHES, CONTRACTORS, FACILITY OPERATORS, LICENSEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, COSTS, LOSSES, OR EXPENSES ARISING OUT OF OR RELATED TO PARTICIPATION IN THE PROGRAM, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE TO THE EXTENT PERMITTED BY LAW.

5. MEDICAL AUTHORIZATION

The parent/legal guardian represents and warrants that the participant is physically and medically capable of safely participating in the Program.

The parent/legal guardian agrees to disclose all relevant:

  • medical conditions;
  • allergies;
  • injuries;
  • medications;
  • dietary restrictions;
  • behavioral conditions;
  • special needs;
    prior to participation.

In the event of illness, injury, or medical emergency, Kaptiva Sports is authorized to obtain emergency medical treatment deemed reasonably necessary for the participant.

The parent/legal guardian accepts full financial responsibility for all medical treatment, ambulance transportation, hospitalization, medication, and related healthcare expenses incurred during or related to participation in the Program.

6. PARTICIPANT CONDUCT

Participants are expected to behave respectfully, safely, and appropriately at all times.

Kaptiva Sports reserves the right to suspend or dismiss any participant, without refund, whose conduct is deemed:

  • dangerous;
  • disruptive;
  • abusive;
  • violent;
  • unlawful;
  • inappropriate;
  • discriminatory;
  • harassing;
  • harmful to participants, staff, facilities, or property.

Possession or use of:

  • weapons;
  • alcohol;
  • tobacco products;
  • vaping devices;
  • illegal drugs;
  • controlled substances;
  • unauthorized medication;

may result in immediate dismissal from the Program without refund and possible notification to law enforcement authorities.

7. MEDIA RELEASE

The participant and/or parent/legal guardian grants Kaptiva Sports Inc., Real Madrid Foundation, and their respective affiliates, sponsors, partners, licensees, broadcasters, and commercial partners a worldwide, perpetual, irrevocable, royalty-free right and license to photograph, record, livestream, film, reproduce, publish, distribute, and otherwise use the participant’s:

  • name;
  • image;
  • likeness;
  • voice;
  • photographs;
  • video recordings;
  • statements;

for promotional, educational, editorial, advertising, social media, commercial, and marketing purposes in any media now known or later developed, without further notice, compensation, or approval.

8. THIRD-PARTY PROVIDERS

Kaptiva Sports may utilize third-party facilities, transportation companies, hotels, medical providers, vendors, independent contractors, coaches, and other service providers in connection with the Program.

Kaptiva Sports shall not be responsible for the acts, omissions, negligence, interruptions, delays, or failures of any third-party provider.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAPTIVA SPORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL KAPTIVA SPORTS’ TOTAL LIABILITY EXCEED THE AMOUNT ACTUALLY PAID TO KAPTIVA SPORTS FOR THE APPLICABLE PROGRAM GIVING RISE TO THE CLAIM.

10. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

The Programs may be operated in multiple states throughout the United States using third-party facilities, operators, coaches, and vendors.

Regardless of where a Program is conducted, any dispute arising out of or relating to this Agreement or participation in the Program shall be exclusively resolved in the state or federal courts located in the State of Florida.

The participant and parent/legal guardian expressly consent to the exclusive jurisdiction and venue of such courts.

11. CLAIM LIMITATION

Any claim against Kaptiva Sports must be submitted in writing within thirty (30) days after the conclusion of the applicable Program.

Any legal action or proceeding must be commenced within one (1) year from the date of the event giving rise to the claim, to the extent permitted by applicable law.

12. PRIVACY

Personal information collected in connection with the Program shall be processed in accordance with the Company’s Privacy Policy available at:

13. SEVERABILITY

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

This Agreement constitutes the complete and exclusive agreement between the parties relating to the Program and supersedes all prior or contemporaneous oral or written communications, representations, or agreements relating thereto.
