Participant Agreement

Effective Date: 1st September 2025

These Terms & Conditions (“Agreement”) govern participation in any Real Madrid Foundation Soccer Camps USA program operated by Kaptiva Sports Inc., a corporation organized under the laws of the State of Florida (“Kaptiva Sports,” “Company,” “we,” “us,” or “our”). By registering for any camp, clinic, event, training session, tournament, trip or related activity (collectively, the “Program”), the participant and/or the participant’s parent or legal guardian agree to be bound by this Agreement.

1. Registration and Payment

A completed registration form and payment of all applicable fees, whether full or partial as specified during registration, are required to reserve a participant’s place. All fees are payable in U.S. Dollars (USD). Kaptiva Sports may refuse, suspend or cancel registration or participation at its discretion for safety, operational, disciplinary or administrative reasons.

2. Cancellation and Refund Policy

Cancellation requests must be submitted in writing by email to info@rmfsoccercampsusa.com. Refunds are issued as follows:

More than 60 days before the Program: amounts paid minus a USD $95 administrative fee.
Between 60 and 30 days before the Program: 50% of amounts paid.
Less than 30 days before the Program: no refund.

No refunds shall be granted for no-shows, voluntary withdrawal, dismissal, late arrivals, illness, injury, homesickness, scheduling conflicts or unused portions of the Program. Approved refunds are processed within a commercially reasonable timeframe.

3. Program Modifications and Force Majeure

Kaptiva Sports may cancel, postpone, relocate, modify or adjust Programs, including schedules, coaches, staff, facilities, accommodations, activities, training sessions, locations and transportation. Programs may use third-party facilities, vendors, operators and service providers. Locations may change within a reasonable geographic area due to operational, safety, weather, governmental, facility, health or other circumstances beyond Kaptiva Sports’ reasonable control. If a Program is cancelled before commencement, Kaptiva Sports’ sole obligation is to refund amounts actually paid for the affected Program.

Kaptiva Sports is not responsible for airfare, hotel, transportation or travel expenses, loss of profits or opportunity, or consequential or incidental damages. Force majeure events include severe weather, natural disasters, pandemics, governmental restrictions, public health emergencies, facility closures, labor disputes, transportation interruptions, terrorism, civil unrest, power outages, coach or staff illness or unavailability, and any event beyond reasonable control.

4. Assumption of Risk and Liability Waiver

Soccer and athletic activities involve inherent risks including physical injury, concussion, dehydration, heat-related illness, infection, permanent disability, paralysis, death, collisions and transportation-related risks. The participant and parent/legal guardian voluntarily and knowingly assume all risks associated with participation.

To the maximum extent permitted by applicable law, the participant and parent/legal guardian release, waive, discharge and hold harmless Kaptiva Sports Inc., Real Madrid Foundation, their affiliates, partners, sponsors, directors, officers, employees, coaches, contractors, facility operators, licensees, agents and representatives from claims, liabilities, damages, costs, losses or expenses arising out of participation, including claims arising from ordinary negligence to the extent permitted by law.

5. Medical Authorization

The parent/legal guardian represents that the participant is physically and medically capable of safely participating and agrees to disclose relevant medical conditions, allergies, injuries, medications, dietary restrictions, behavioral conditions and special needs before participation. In an illness, injury or medical emergency, Kaptiva Sports may obtain emergency medical treatment reasonably necessary. The parent/legal guardian accepts financial responsibility for medical treatment, ambulance transportation, hospitalization, medication and related healthcare expenses.

6. Participant Conduct

Participants must behave respectfully, safely and appropriately. Kaptiva Sports may suspend or dismiss without refund any participant whose conduct is dangerous, disruptive, abusive, violent, unlawful, inappropriate, discriminatory, harassing or harmful to people or property. Possession or use of weapons, alcohol, tobacco, vaping devices, illegal drugs, controlled substances or unauthorized medication may result in immediate dismissal and possible notification to law enforcement.

7. Media Release

The participant and/or parent/legal guardian grants Kaptiva Sports Inc., Real Madrid Foundation and their affiliates, sponsors, partners, licensees, broadcasters and commercial partners a worldwide, perpetual, irrevocable, royalty-free right to photograph, record, livestream, reproduce, publish, distribute and otherwise use the participant’s name, image, likeness, voice, photographs, video recordings and statements for promotional, educational, editorial, advertising, social media, commercial and marketing purposes in any media now known or later developed, without further notice, compensation or approval.

8. Third-Party Providers

Kaptiva Sports may use third-party facilities, transportation companies, hotels, medical providers, vendors, independent contractors, coaches and other service providers. Kaptiva Sports is not responsible for their acts, omissions, negligence, interruptions, delays or failures.

9. Limitation of Liability

To the maximum extent permitted by law, Kaptiva Sports shall not be liable for indirect, incidental, consequential, special, exemplary or punitive damages. In no event shall total liability exceed the amount actually paid to Kaptiva Sports for the applicable Program giving rise to the claim.

10. Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Florida. Regardless of where a Program is conducted, disputes arising out of this Agreement or participation in a Program shall be resolved exclusively in state or federal courts located in Florida, to whose jurisdiction and venue the participant and parent/legal guardian expressly consent.

11. Claim Limitation

Any claim against Kaptiva Sports must be submitted in writing within 30 days after the applicable Program. Any legal action must be commenced within one year from the event giving rise to the claim, to the extent permitted by applicable law.

12. Privacy

Personal information collected in connection with the Program is processed in accordance with the Privacy Policy and Cookie Policy.

13. Severability

If any provision is invalid, illegal or unenforceable, the remaining provisions remain in full force and effect.

14. Entire Agreement

This Agreement constitutes the complete and exclusive agreement between the parties relating to the Program and supersedes prior or contemporaneous communications, representations or agreements relating thereto.
